एयर इंडिया, जिसके निजीकरण के सम्बन्ध में पिछले दिनों लगातार चर्चा चल रही है, को अपने स्वयं के निजीकरण के सम्बन्ध में कोई जानकारी नहीं है. आरटीआई एक्टिविस्ट डॉ नूतन ठाकुर ने एयर इंडिया से उसके निजीकरण के सम्बन्ध में उसके तथा अन्य कार्यालयों में हुए पत्राचार सहित निजीकरण प्रस्ताव विषयक समस्त अभिलेख देने का अनुरोध किया था. एयर इंडिया के एजीएम (ओए) एस के बजाज ने 11 जुलाई 2017 के अपने पत्र द्वारा बताया कि एयर इंडिया ने किसी प्रस्तावित निजीकरण के सम्बन्ध में किसी भी कार्यालय से कोई पत्राचार नहीं किया है और न ही उसे इस सम्बन्ध में कोई भी पत्र प्राप्त हुआ है. अतः उसे प्रस्तावित निजीकरण के सम्बन्ध में कोई सूचना नहीं है. नूतन के अनुसार यह आश्चर्यजनक है कि जिस कंपनी का निजीकरण प्रस्तावित है, वह ही इस पूरी प्रक्रिया से अलग रखा गया दिख रहा है.
Air India has no info on its disinvestment plan
Air India, whose proposed privatization is in news recently, does not have any information in this regards. RTI activist Dr Nutan Thakur had requested Air India to provide the documents related with its proposed disinvestment, including those exchanged between Air India and different offices. SK Bajaj, AGM (OA), Air India told through his letter dated 11 July 2017 that Air India has not made any communication to any other officers nor has it received any communication from any of the departments in respect of the proposed disinvestment of Air India. Hence, it has no information to provide in this regards. As per Nutan, it is truly strange that the Company whose privatization is being planned, seems to be out of the loop in the process.
पीआईएल पर कोई कानूनी रोक नहीं- डीओपीटी
भारत सरकार के कार्मिक और प्रशिक्षण विभाग (डीओपीटी) से आरटीआई के अनुसार अखिल भारतीय सेवा आचरण नियमावली 1968 में ऐसा कोई प्रावधान नहीं है जो आईएएस अथवा आईपीएस अफसर को जनहित याचिका (पीआईएल) दायर करने से रोकता हो. यूपी कैडर के आईपीएस अफसर अमिताभ ठाकुर द्वारा दायर एक पीआईएल पर इलाहाबाद हाई कोर्ट ने सरकारी सेवकों द्वारा पीआईएल दायर करने पर स्पष्ट नीति बनाने के आदेश दिए थे. अमिताभ ने डीओपीटी से हाई कोर्ट के आदेश के पालन के सम्बन्ध सूचना मांगी थी. डीओपीटी के नोटशीट में साफ अंकित है कि पीआईएल दायर करने पर कोई रोक नहीं है. इसमें वी एस पाण्डेय केस में सुप्रीम कोर्ट द्वारा सरकारी कर्मियों द्वारा पीआईएल दायर करने को उनका संवैधानिक अधिकार बताये जाने का भी उल्लेख है. साथ ही डीओपीटी न्यायिक उपचार के अधिकार और जन सेवा पर उसके प्रभाव में संतुलन बनाने के लिए पूर्वानुमति के बाद पीआईएल की नीति पर विचार कर रहा है किन्तु इस बात पर भी चिंतित है कि प्रभावित प्राधिकरण इस हेतु अनुमति क्यों देगा.
No prohibition on IAS to file PIL- DOPT
RTI information by Department of Personnel and Training (DOPT), Government of India has revealed that there is no provision in the All India Services (Conduct) rules 1968 that prohibits an IAS or IPS officer from filing Public Interest Litigations (PIL) before the Court. In a PIL filed by UP cadre IPS officer Amitabh Thakur, Allahabad High Court had directed to formulate policy as regards government servants filing PILs. Amitabh had sought information from the DOPT about the compliance of the High Court order. The DOPT notesheet clearly states that there is no restriction to file PIL. It also mentions the case of V S Pandey where the Supreme Court has upheld the right of public servants to file PILs. Yet, in order to have a balance between right to judicial remedy and its adverse effect on public service, DOPT is thinking of a policy of public servants taking permission to file PILs, while also worrying on why an affected authority grant permission against itself.
पीएम विदेश यात्रा की सूचना देने से पीएमओ ने मना कर दिया
प्रधान मंत्री कार्यालय ने भारत के प्रधानमंत्री द्वारा किये गए विदेश यात्राओं में आये खर्च के सम्बन्ध में मांगी गयी सूचना देने से मना कर दिया है. आरटीआई एक्टिविस्ट डॉ नूतन ठाकुर ने 01 जनवरी 2010 के बाद से प्रधानमंत्री की विदेश यात्राओं में की गयी विभिन्न व्यवस्थाओं में हुए खर्चों से सम्बंधित प्रधानमंत्री कार्यालय के अभिलेख दिए जाने का अनुरोध किया था. प्रधानमंत्री कार्यालय के जन सूचना अधिकारी तथा अनु सचिव प्रवीन कुमार ने यह कह कर सूचना देने से मना कर दिया कि मांगी गयी सूचना अत्यंत अस्पष्ट और विस्तृत है.
Info on PM foreign visit denied as vague
The Prime Minister Office has denied the information sought as regards the various expenses incurred in the foreign trips made by the Prime Minister of India. RTI activist Dr Nutan Thakur had requested to provide the documents in the Prime Minister Office (PMO) as regards the various expenses incurred for various arrangements made for these foreign trips from 01 January 2010 onwards. Praveen Kumar, CPIO and Under Secretary in PMO, has denied the information saying that the information sought is too vague and wide.
