In the PIL filed by social activist Dr Nutan Thakur, today the UP government vociferously opposed CBI enquiry in Yadav Singh case before Lucknow bench of Allahabad High Court. Advocate General Vijay Bahadur Singh, appearing on behalf of the State government, said that the government has already appointed Justice A N Verma enquiry commission, which is sufficient by itself. He said the government will think of CBI enquiry only if the enquiry commission recommends so.
Dr Thakur opposed this saying that though the commission has been formed no paraphernalia have been provided nor any time frame fixed. Secondly the government is opposing CBI enquiry merely to save powerful people, despite directions of SIT. Having heard both the parties, the bench of Justice Imtiyaz Murtaza and Justice Rituraj Awasthi directed the State government to file an affidavit presenting its actions taken so far. It also directed all the respondents to place the relevant documents related with the case before the Court. The matter shall be heard next on 16 March.
यादव सिंह कांड की सीबीआई जांच नहीं चाहती यूपी सरकार
यादव सिंह मामले में सामाजिक कार्यकर्ता डॉ नूतन ठाकुर द्वारा इलाहाबाद हाई कोर्ट की लखनऊ बेंच में दायर पीआईएल में उत्तर प्रदेश सरकार ने सीबीआई जांच का पुरजोर विरोध किया. सरकार की ओर से महाधिवक्ता विजय बहादुर सिंह ने कहा कि सरकार ने इस मामले में जस्टिस ए एन वर्मा जांच कमीशन बना दी है और यह पर्याप्त है. उन्होंने कहा कि सरकार सीबीआई जांच तभी कराने पर विचार करेगी यदि जांच कमीशन इसकी संस्तुति करेगी.
इसके विरोध में डॉ ठाकुर ने कहा कि एक तो सरकार ने जांच कमीशन को कोई संसाधन मुहैया नहीं कराया है और कोई समय सीमा नहीं दिया है, दूसरे वह एसआईटी के कहने के बाद भी सीबीआई जांच का विरोध इसीलिए कर रही है क्योंकि वह ताकतवर लोगों को बचाना चाहती है. दोनों पक्षों की बात सुन कर जस्टिस इम्तियाज़ मुर्तजा और जस्टिस ऋतुराज अवस्थी की बेंच ने राज्य सरकार को हलफनामा दायर के आदेश दिए और वादिनी से कहा है कि यदि उन्हें इस पर कोई आपत्ति हो तो वे इसे अदालत के सामने रखेंगी. कोर्ट ने प्रतिवादीगण को मामले से सम्बंधित समस्त अभिलेख न्यायालय के सामने रखने के भी आदेश दिए. मामले की अगली सुनवाई 16 मार्च को नियत की.
