Samar Anarya : अभी-अभी साथी Shruti Chaturvedi और Utpala Shukla ने श्रीमती कविता कृष्णन, पोलित ब्यूरो सदस्य, भाकपा माले लिबरेशन से कुछ सार्वजनिक सवाल पूछते हुए यह बयान जारी किया है. मैं सवालों से सहमति जताते हुए उसका अविकल हिंदी अनुवाद यहाँ पेश कर रहा हूँ-

“21 January 2014” को आईएसडी की तरफ से यह मेल श्रीमती कविता कृष्णन को (कामरेड दीपांकर भट्टाचार्य को प्रतिलिपि के साथ) उत्पला और मैंने भेजा था. इस मेल का जवाब देने की फुरसत उन्हें आज तक नहीं मिली है. उलटा, आज उन्होंने साफ इंकार किया कि उनको कोई मेल नहीं मिली। इसके ठीक विपरीत हमारी जानकारी के हिसाब से उन्हें ये मेल मिली और उन्होंने इस मेल पर एक मीटिंग बुलाई थी. थोड़ी देर पहले हमारी साथी उत्पला शुक्ला ने जब उनसे फोन पर बात की तो उन्होंने बेहद अशालीन तरीके से बात कि और बात के बीच में ही फ़ोन काट दिया। आईएसडी और खुर्शीद अनवर के तमाम साथियों को इन सवालों के जवाब चाहिए…

हम खुर्शीद अनवर पर लगे तथाकथित बलात्कार के आरोपों और उनकी आत्महत्या के मामले में अग्रणी रहे कुछ लोगों की भूमिका पर कुछ सवाल उठाना चाहते हैं. क्योंकि आप इस पूरे मामले में शुरुआत से ही शामिल थीं, हम आपसे कुछ सवाल कर रहे हैं.

१. आपको कथित बलात्कार के बारे सूचना कहाँ से और किनसे मिली?

२- यह लोग कौन थे और किस संगठन के थे? क्या वह आप या आपके संगठन के पूर्वपरचित थे?

३- क्या आप सीडी के अस्तित्व के बारे में जानती थीं? क्या आप यह जानती थीं कि यह सीडी सक्रिय सर्कुलेशन में थी?

४ – आपने इस (मामले में) कार्यवाही अपनी निजी हैसियत में की या सांगठनिक स्तर पर? क्या इस विषय में आपके संगठन या पार्टी में किसी फोरम में चर्चा की गयी थी?

५- क्या आपको एक बार भी इस सीडी को बनाने की प्रक्रिया पर्स संदेह हुआ?

६- क्या एक कथित बलात्कार पीड़िता का वीडिओ बनाना सही प्रक्रिया है? क्या आपने सीडी या सूचना लेकर आपके पास आये लोगों को कभी यह बताया कि इस सीडी का वितरण नहीं होना चाहिए? क्या आपको यह पता नहीं था कि डॉ आशुतोष कुमार लोगों को यह सीडी देखने के लिए प्रोत्साहित कर रहे थे, यह कहते हुए कि वह निश्चित थे कि खुर्शीद अनवर ने बलात्कार किया है? क्या आपने इस कार्यवाही का समर्थन किया या रणनीतिक रूप से इसे इग्नोर कर दिया?

७. क्या आपने (इस मामले में) कोई एफआईआर और कोई मेडिकल जांच न होने के बारे में सवाल उठाये?

८- क्या आपको कोई सूचना है कि तथाकथित पीड़िता को कोई मेडिकल मदद मिली या नहीं?

९- क्या आपने किसी और नारीवादी/स्त्रीवादी संगठन से संपर्क किया या उनसे यह सूचना साझा की?

१०- क्या आपके पास यौन हिंसा के मामलों को डील करने करने का कोई अनुभव था? क्या आपने ऐसा अनुभव रखने वाले व्यक्तियों और संगठनों से सम्पर्क करने का कोई प्रयास किया?

११- नारीवादी/स्त्रीवादी कार्यवाहियों ने हमेशा साझा कार्यवाही में विश्वाश किया है. क्या दिली के नारीवादी/स्त्रीवादी समूह को आप और आपके सहकर्मियों द्वारा उठाये जा रहे क़दमों का पता था?

12- क्या यह आपका निजी निर्णय था या सांगठनिक कि सोशल मीडिआ पर एक कैम्पेन शुरू कर ‘संदिग्ध’ या आरोपी पर हत्यारी भीड़ छोड़ दी जाय?

१३- आपने आईएसडी के बोर्ड मेबर्स से संपर्क कब किया? क्या आप आईएसडी द्वारा शुरू की गयी कार्यवाही से अवगत थीं?क्या आपने अपने कामरेड्स को आईएसडी बोर्ड की मदद करने और सोशल मीडिया पर भीड़ की अदालत या कंगारू अदालत न लगाने को कहा? क्या आपको यह नहीं पता था कि खुर्शीद अनवर ने उनके निर्दोष साबित होने तक आईएसडी के निदेशक पद से हटने का प्रस्ताव किया था?

१४- (इस मामले में) किसी कानूनी प्रक्रिया का अनुसरण नहीं किया गाय?क्या अआपने ऐसा करने का कोई प्रयास किया? आप तो जानती ही होंगी कि नए क़ानून के तहत कोई भी व्यक्ति जो ऐसा मामला जानता हो उसे पुलिस को सूचित कर सकता है? आप या आपके संगठन ने इस दिशा में क्या किया?

15- क्या अपने बूँद टीम की आतंरिक राजनीति को जानने का कोई प्रयास किया? यदि आप ऐसा करतीं, तो आपको बूँद के अन्दर की लड़ाइयों और आर्थिक मसलों का पता चलता। आपको यह भी पता चलता कि बूँद के अंदर शक्ति संबंधों की लड़ाई में अगुआ रहे लोग ही ‘वीडिओ दिखाओ कैम्पेन’ और फेसबुक पर न्याय करने के कैम्पेन के अगुआ लोग थे.

१६- क्या आपको पता है कि सिर्फ खुर्शीद अनवर ही थे जिन्होंने इस मामले में विधिक/न्यायिक प्रक्रिया का अनुसरण किया? उन्होंने फेसबुक पर भी अपना खलनायकीकरण रोकने और एफ़आईआर दर्ज करने का अनुरोध किया जिससे उन्हें अपना पक्ष रखने का अवसर मिल सके. पर इसकी प्रतिक्रिया में फेसबुक पर उनके खिलाफ अभियान और तेज हो गया और आज भी चल रहा है. उन्होंने 29 नवम्बर 2013 को अपनी मानहानि के खिलाफ पुलिस में तीन स्तरों पर शिकायत की. 17 दिसम्बर 2013 को यह मामला अदालत में दर्ज हुआ. क्या आपको एक बार भी समझ आया कि तथाकथित अभियुक्त खुद न्यायिक प्रक्रिया में जा रहा है जबकि कथित पीडिता, उसके मित्र और फेसबुक समर्थक क़ानून का मजाक उड़ा रहे हैं?

१७- अगर खुर्शीद अनवर दोषी रहे भी हों तो क्या यह पत्थर मार के हत्या करना न्याय पाने का सही रास्ता है? आपके संगठन/पार्टी के लोगों ने इस मीडिया ट्रायल में सक्रिय हिस्सेदारी की है. क्या भीड़तंत्र ही वह रास्ता है जिसे आप भविष्य में प्रोतसाहित करने जा रही हैं?आप और आपका संगठन उस मीडिया ट्रायल पर चुप क्यों है जो खुर्शीद अनवर की आत्महत्या में निर्णायक कारण बना?

18. खुर्शीद का खलनायकीकारन उनकी मृत्यु के बाद भी जारी है. हमने आपके मुंह से इस नाकाबिलेबर्दाश्त घृणा कैम्पेन के बारे में एक शब्द भी नहीं सुना। क्या यही ऐसे मामलों में न्याय पाने का रास्ता है?
आप एक स्त्री संगठन की सदस्य और एक राजनैतिक दल की नेता हैं. आपको भविष्य में ऐसे, और इससे भी उलझे हुए केसेस मिलेंगे। आपने इस दुखद मामले में अपनी और अपने पार्टी सदस्यों की भूमिका के बारे में कोई इंट्रोस्पेक्शन किया है? क्या जो हुआ उसके लिए आप खुद को किसी भी प्रकार से उत्तरदायी समझती हैं?
हम शोक में हैं पर हमारा दर्द आपकी जघन्य असंवेदनशीलता और विधिक प्रकिर्या के लिए कोई सम्मान न होना देख के और बढ़ जाता है. आशा है आप हमारी चिंता समझेंगी और उत्तर देंगी।

Is mail ka jawab dene ki fursat unhe aaj tak nahi mili hai. Utla aaj unhone saaf inkaar kiya ki unhe koi mail nahi mili. Iske theek vipreet humari jankari ke hisaab se unhe ye mail mili aur unhone is mail pe ek meeting bulai thi.

thodi der pehle humari saathi Utpala Shukla ne jab unse phone pe baat ki to unhone behad ashaaleen tarike se baat ki aur baat ke beech main hi ph kaat diya.

Dear Ms. Kavita Krishnan,

Greetings

We want to raise some questions on the role played by people who were active and in the fore front in taking up the allegation on Khurshid Anwar of alleged rape and his suicide. Since you were involved from the beginning in this entire episode, we are posing some questions to you.

1. From whom and when did you get the information about the alleged rape?

2. Who were these people and from which organization? Were they known to you or to your organization, earlier?

3. Were you aware of the existence of the CD? Did you know that it was in active circulation?

4. Did you take the action in your personal capacity or at your organizational level? Was it discussed at any forum in your organization or party?

5. Did you ever suspect the process or the making of C.D.?

6. Is making video of an alleged rape victim the right process? Did you ever tell the people who had come to you with the CD or information that CD should not be circulated? Were you not aware that Dr. Ashutiosh Kumar was encouraging people to watch the CD telling them that he was convinced that Khurshid Anwar had committed this rape? Did you approve this method or tactically ignore it?

7. Did you raise question about no FIR, no medical inquiry?

8. Did you have any information whether the alleged victim got any medical help or not?

9. Did you try to contact other feminist organizations and share this information with them?

10. Do you have any experience of dealing with a case of sexual violence? Did you contact persons, organizations with such experience?

11. Feminist action has always believed in collective action. Was the Delhi feminist circle aware of the steps you and your colleagues were taking in this case?

12. Was it your personal decision or your organizational decision that a campaign be launched on social media and lynch mob unleashed on the suspect or accused?

13. When did you contact the board members of the ISD? Were you aware of the action initiated by the ISD? Did ask you comrades to help the board of the ISD and not go on enacting mob court on social media? Did you not know that khurshid had offered to step down as director, ISD till his name was cleared?

14. No legal procedure was followed. Did you try to initiate it in nay manner? You must be aware that under the new law, anybody who knows about such an allegation, can report it to the police. What did you or your organization do in this direction?

15. Did you make any effort to know the internal politics of Boond team? If you would have, then you would know about internal clashes and money issues there. You would have also known that it is the same group of people involved in ‘showing video campaign’ and seeking facebook justice who were in the forefront of the power struggle within Boond team.

16. Are you aware that it was only Khurshid Anwar who went with the legal way? He even requested on the facebook to stop his vilification and file an FIR so that he gets chance to put his side properly. But in response vilification campaign against him further increased which continues till date. On the 29th November 2013 he filed a complaint against his defamation in police at three levels. On the 17th December 2013 this case got registered in the court. Did you ever notice this fact that the so called accused himself is approaching the law and the so called victim, her friends and the facebook supporters are mocking the law?

17. Even if Khurshid Anwar was guilty, will this stoning to death be the way to get justice? People from your organization/party have actively participated in this media trial. Are we going to encourage this mob justice in future? Why you and your organization have remained silent on this media trial which became a decisive factor in Khurshid Anwar’s suicide?

18. Vilification of Khurshid continues, even after his death. We have not heard a word from you condemning this unacceptable hate campaign. Is this how campaign for justice in such cases conducted?

You are part of a women’s organization and leader of a political party. You ‘ll have to deal with cases of this nature and even more complicated ones in future. What introspection have you done regarding your own role, the part played by your party colleagues in this whole tragic campaign? Do you feel any responsibility for whatever happened?

We are in grief but this pain intensifies when we see cold insensitivity and little regard for processes in such matters gaining ground. Hope you ‘ll appreciate our concern and respond ,
