सुप्रीम कोर्ट ने आम्रपाली बिल्डर्स की नकेल कस दी है. 250 करोड़ रुपए फौरन सुप्रीम कोर्ट की रजिस्ट्री में जमा कराने का आदेश दे दिया है. यह रकम 15 जून से पहले पहले जमा कराना होगा. इसके लिए यूको बैंक में एस्क्रो escrow एकाउंट खोला जाएगा. सुप्रीम कोर्ट ने कहा है कि होम बायर्स अब आम्रपाली को भुगतान तब करेंगे जब निर्माण कंप्लीट हो जाएगा और पजेशन लेटर मिल जाएगा. पजेशन लेटर मिलने के तीन महीने में होम बायर्स सारा भुगतान कर देंगे, उसके पहले आम्रपाली को एक भी पैसा होम बायर नहीं देंगे.
सुप्रीम कोर्ट ने ए, बी और सी कैटगरी में होम बायर्स को बांट रखा है. ए कैटगरी में सबसे ज्यादा काम हो चुका है. सी कैटगरी में या तो काम शुरू ही नहीं हुआ है या बस नाम मात्र का काम हुआ है. सुप्रीम कोर्ट ने सी कैटगरी वाले प्रोजेक्ट्स को दूसरे प्रोजेक्ट के साथ बदलने के लिए कहा है. यह विकल्प भी दिया कि जो लोग फ्लैट बदलना नहीं चाहते, उन्हें रिफंड कर दिया जाए. आम्रपाली ने सफायर 1 और 2 व लेजर पार्क को लेकर अपना प्रस्ताव सुप्रीम कोर्ट को सौंपा. इसे पूरा करने के लिए तीन से 15 महीनों तक का टाइम मांगा है.

Highlights of the court order today…
Timeline for completion of all the projects fixed as well as the Co- developers decided who shall be completing the projects and infusing funds into these projects. Both the promoter as well is the codeveloper shall file respective undertakings within a period of seven days as to their adherence to the timelines fixed.
Dreamvalley to to be completed within a period of 30-42 months.
A committee shall be formed with representatives of both buyers and the promoter to monitor the progress.
No money shall be collected from the buyers prior to possession. Money shall be released only after the committee certifies that construction has been done as per specifications promised to buyers. The committee shall have the following constitution
One Chartered accountant each to be appointed by promoter and buyers
One Chartered engineer each to be appointed by the promoter and the buyers
Two representatives of the buyers
One representative from Noida authority
The promoter has been further directed to deposit a sum of Rs.2 50 crores to an escrow account to be opened with UCO bank, Supreme Court branch, to ensure that the projects once started do not face liquidity issues.
For buyers of projects falling in category C, the promoter shall also make arrangements for swapping of their apartments to projects of category A & B. Unsold inventory can be sold in the free market only after swapping process is complete. Buyers interested in swapping their apartment have to place request directly to the promoter. However, in event of any grievance , the buyer can write to the committee.
The court also noted that there are certain buyers who are not in a position to continue with their allotments and seek a refund of their money in such cases. The promoter has been directed to file a proposal before the next date of hearing for buyers seeking refund of their money. The next date of hearing in the matter is fixed for 18th of July.
