केंद्रीय सूचना आयोग ने भारतीय रिजर्व बैंक (आरबीआई) को 10 दिनों में देश के बड़े बकायेदारों की सूची लखनऊ स्थित एक्टिविस्ट डॉ नूतन ठाकुर को प्रदान करने के आदेश दिए हैं, जिन्होंने देश के बड़े बकायेदारों के संबंध में आरबीआई द्वारा बनायीं गयी दो सूची से जुडी सूचना मांगी थी.
आरबीआई के जन सूचना अधिकारी ने आरटीआई एक्ट की धारा 8(1)(डी) में सूचना देने से मना कर दिया था, जबकि अपीलीय अधिकारी ने इसे बैंकों द्वारा दी गयी ऋण विषयक सूचना बताते हुए इसे आरबीआई एक्ट की धारा 45ई में निषिद्ध बताया था.
सूचना आयुक्त सुरेश चंद्रा ने नूतन की इस बात से सहमति व्यक्त की कि यह सूचना पूरी तरह जनहित से जुडी है क्योंकि बड़े बकायेदारों की सूची का लोकहित में विशेष महत्व है तथा लोगों को इनके नाम जानने का पूरा अधिकार है, अतः इन बड़े बकायेदारों का नाम छिपाया जाना आरबीआई एक्ट के विपरीत होगा.
आयोग ने आरबीआई को बड़े बकायेदारों की सूची प्रदान करने के आदेश दिए यद्यपि वे आरबीआई के इस मत से सहमत थे कि इन बकायेदारों से संबंधित पत्रावली के समस्त अभिलेख दिए जाने की जरुरत नहीं है.
CIC directs RBI to provide big defaulters list
Central Information Commission has directed the Reserve Bank of India (RBI) to provide within 10 days the list of big defaulters to Lucknow based activist Dr Nutan Thakur, who had sought information about two lists of big defaulters prepared by RBI itself.
The CPIO of RBI had denied information under section 8(1)(d) of RTI Act, while the Appellate Authority denied information saying that it is prohibited under section 45E of the RBI Act, which says that any credit information submitted by banks shall be treated as confidential as this information was obtained through Banks.
Information Commissioner Suresh Chandra agreed with Nutan’s submission that the information is being sought purely in public interest because the list of defaulters is of immense public importance and the people have a right to know about these defaulters, so that hiding names of big defaulters is definitely against the spirit of RBI Act.
The Commission therefore directed RBI to provide list of big defaulters, while agreeing with RBI that it need not provide copy of the entire files related with these defaulters.
