मानहानि का मुकदमा दायर करने वाले एमजे अकबर हार गए!

एम जे अकबर का पत्रकार प्रिया रमानी के ख़िलाफ़ मानहानि का मुक़दमा ख़ारिज करते हुए अदालत ने ये पाँच बातें कही –

  1. औरतों को यौन शोषण के विरुद्ध आवाज़ उठाने की सज़ा नहीं दी जा सकती है। संविधान उन्हें किसी भी वक़्त अपनी बात रखने की सहूलियत देता है।
  2. इस बात को नज़रअन्दाज़ नहीं किया जा सकता है कि यौन शोषण के अधिकतर मुआमले, बंद कमरों में होते हैं। अधिकतर औरतें सिर्फ़ डर की वजह से आवाज़ नहीं उठा पाती हैं।
  3. प्रिया रमानी ने अपनी बातों का ख़ुलासा कार्यस्थल पर होने वाले यौन शोषण के ख़िलाफ़ किया था। कोर्ट कार्यस्थल पर होने वाले सुनियोजित यौन शोषण से इत्तेफ़ाक रखती है।
  4. समाज को यौन शोषण और इससे होने वाले कुप्रभाव के बारे में समझना चाहिए। यौन शोषण पीड़ित के सम्मान और आत्म-विश्वास को ख़त्म कर देता है।
  5. कोई व्यक्ति (वह सामाजिक रूप से कितना ही माननीय क्यों ना हो) यौन शोषक हो सकता है। किसी के भी सामाजिक मान की रक्षा किसी और के सम्मान के अधिकार के एवज़ में नहीं की जा सकती ( संदर्भ : एम जे अकबर का कहना कि सुश्री रमानी के आरोपों ने उनके सामाजिक मान को क्षतिग्रस्त किया।)

A Victory for Women Journos in India

The National Alliance of Journalists(NAJ) and Delhi Union of Journalists(DUJ) welcomes the judgement absolving journalist Priya Ramani of defamation in the case filed against her by former editor and ex Union minister M.J. Akbar. Ramani had dared to write about being sexually harassed by Akbar, then her boss at the Asian Age.

Her revelations during the #MeToo movement two years ago had sparked off a series of explosive allegations by as many as 14 women journalists about being propositioned, called to the boss’ hotel room at odd hours etc. Akbar chose to file a defamation case against Ramani alone, ignoring the others’ allegations. After the acquittal Ramani said, “It feels amazing. I feel vindicated on behalf of all the women who have ever spoken out against sexual harassment. Sexual harassment has got the attention it deserves. Despite the fact that it was me, the victim, who had to stand up in court as the accused.”

The NAJ -DUJ Gender Council commends the outstanding criminal lawyer Rebecca John who valiantly fought a difficult case against a powerful man and has described it as “the most important case of my career”. Her defence significantly rested on that fact that Ramani was speaking the truth for the public good.

The NAJ – DUJ Gender Council also commends journalist Ghazala Wahab and Niloufer Venkatraman who testified on behalf of Ramani.

Delhi’s Additional Chief Metropolitan Magistrate Ravindra Pandey has observed in his path breaking order that,”Sexual abuse takes away dignity and self confidence.” He has said, “the right of reputation cannot be protected at the cost of right to dignity.” Since Ramani’s allegations dated back to 1994, he has also observed that, “a woman has right to put her grievance even after decades.”

The DUJ’s Gender Council notes that these observations set a valuable precedent for all cases of sexual harassment. The judgement is a major victory for the women’s movement.
