Complaint For Registration of FIR Against the Accused Under Sections 153A, 153B, 504, 505(1), 505(2) of the Indian Penal Code and S.67 of I.T. Act

Complainant submits as follows:
The complainant is a concerned citizen and is filing this complaint against offences committed by the Accused namely inciting hatred between religious communities, doing acts prejudicial to national integration as well issuing statements conducive to public mischief.
The accused is the chairman, managing director and the editor-in-chief of TV Channel Sudarshan News.
Accused used the social media platform Twitterto publish inflammatory and criminal statements targeting the Muslim community. These statements have been published and circulated with the intention to cause enmity, hatred and ill will in between religious communities and goes against the secular fabric of your country. In a time when religious violence is becoming increasingly common, it is also possible that such statements are designed to provoke religious violence.
These statements, published on the internet, have a wide reach.They are instantly accessible to people all over the country and are clearly designed to get attention for Mr. Suresh Chavhanke at the cost of social harmony and provoking violence and hatred against religious minorities and Muslim officers of the All-India Civil Services.
On 25th August, 2020, at 8:10pm, a verified Twitter account by the handle of @SureshChavhanke published a tweet which said “#सावधान लोकतंत्र के सबसे महत्वपूर्ण स्तंभ कार्यपालिका के सबसे बड़े पदों पर मुस्लिम घुसपैठ का पर्दाफ़ाश. #UPSC_Jihad #नौकरशाही_जिहाद देश को झकझोर देने वाली इस सीरीज़ का लगातार प्रसारण प्रतिदिन. शुक्रवार 28 अगस्त रात 8 बजे से सिर्फ सुदर्शन न्यूज़ पर.”
Roughly translated in English, the tweet says “#Attention Exposing the Muslim infiltration into the highest posts of the most important institutions of our democracy. #UPSC_Jihad #Civil_Services_Jihad. Daily telecast of this serious which will shake the nation. Only on Sudarshan News from Friday 28th August 8pm onwards.”
A screenshot of this tweet along with a link to the tweet (and Suresh Chavhanke’s verified Twitter account) is attached with this complaint as ANNEXURE 1.
The tweet is accompanied by a video trailer where the accused Mr. Suresh Chavhanke talks about how Muslims have infiltrated the highest posts in our civil services such as the Indian Administrative Services (IAS) and calls them terrorists. In the video, he also seeks to incite hatred against Muslim IAS officers by claiming that the rising number of Muslim officers in higher civil services posts is a form of terrorism or “jihad”.
A plain reading of the ‘tweet’ is all it takes to understand the criminal intent behind the statement. Accused is seeking to paint Muslims with the brush of communalism and is encouraging hatred and inciting feelings of hate against Muslims. As per the Accused, the rising number of Muslim civil servants in senior positions in the IAS and civil services is suspect and that they are “jihadis” (or terrorists). The tweet of the accused has been liked and retweeted hundreds of times.
It explicitly falls in the category of ‘hate-speech’. Such statements constitute the offence under Section 153A as it is clearly “Promoting enmity between different groups on grounds of religion” and Section153A is cognizable. Section 153B (1)(a) states “whoever by words either spoken or written or by signs or by visible representations or otherwise, makes or publishes an imputation that any class of persons cannot by reason of their being members of any religious, racial, language or regional group or caste or community bear true faith and allegiance to the Constitution of India as by law established or uphold the sovereignty or integrity of India”. Section 153B criminalises statements prejudicial to national integration. Questioning the credentials of each and every Muslim officer of the Indian Civil Services and referring to Muslims joining the civil services as “jihad” or terrorism is clearly aimed at damaging national integration and fostering ill- will and thus violates Section 153B of the IPC as well. These tweet is also a statement conducive to mischief and is aimed at disturbing peace in society. As such, the tweets also violate Sections 504 and 505 of the Indian Penal Code.
The Accused has in the past too published such derogatory and venomous comments targeting the religious minorities and also broadcast them on his news channel, and hence, this action cannot be taken lightly. Far reaching consequences follow such hate speech in a diverse country like ours. It is this consistent pattern that also requires further investigation.
In view of the aforesaid submission made here in and in the interest of the justice, it is therefore requsted that you may please register an FIR against the accused for committing the offences under Sections 153A, 153B, 504, 505(1), 505(2) of the Indian Penal Code and S.67 of I.T. Act, 200
