निलंबित आईपीएस अफसर अमिताभ ठाकुर ने आज गुजरात के अतिरिक्त मुख्य सचिव (गृह) पी के तनेजा को पत्र लिख कर निलंबित आईपीएस अफसर संजीव भट्ट को कथित सेक्स-वीडियो के लिए नोटिस दिए जाने पर आपत्ति दर्ज कराई है.
उन्होंने कहा कि यद्यपि श्री भट्ट ने वीडियो में होने से मना किया है पर यदि वे उस वीडियो में होते भी, तब भी उसे तब तक प्रशासनिक कदाचार अथवा आईपीएस अफसर के लिए अनुचित नहीं कहा जा सकता था, जब तक वह निजी और सहमति से हुआ मामला था और इस मामले में मात्र उनके परिवार वालों को ऐतराज़ करने का अधिकार था.
श्री ठाकुर ने कलकत्ता हाई कोर्ट के 1985 के इन रे रबिन्द्र नाथ घोष तथा इलाहबाद हाई कोर्ट के 1989 के स्टेट ऑफ़ यूपी बनाम बी एन सिंह मामलों सहित कई निर्णयों के आधार पर कहा कि एक सरकारी कर्मी के ऐसे निजी मामलों को प्रशासनिक कार्यवाही का आधार नहीं बनाया जा सकता.
उन्होंने कहा कि श्री भट्ट की पृष्ठभूमि को देखते हुए एक निजी मामले को सार्वजनिक करने से कई सारे सवाल खड़े होते हैं और उनकी निजता के अधिकार का हनन दिखता है, जिसके लिए उत्तरदायित्व निर्धारित किया जाना उचित होगा.

Suspended UP IPS officer Amitabh Thakur today wrote to Gujarat Additional Chief Secretary (Home) P K Taneja objecting to the notice given to suspended IPS officer Sanjeev Bhatt after surfacing of an alleged sex-video.
He said that while Sri Bhatt has denied being in the video, but even if he were there in the video with a woman other than his wife, it could never have been considered a misconduct and unbecoming of an IPS officer as long as the matter was private and consensual, where only his family members had a right to object.
Sri Thakur quoted many decisions including 1985 Calcutta High Court decision in re Rabindra Nath Ghosh and 1989 Allahabad High Court decision in State of UP vs BN Singh to state that an officer’s such private conduct cannot be made a ground for action.
He said given Sri Bhatt’s background, making a private matter public, raises many eye-brows and is an intrusion into his right to privacy for which responsibility shall be fixed.
