लखनऊ : आरटीआई कार्यकर्ता डॉ नूतन ठाकुर ने सूचना आयुक्त हाफिज उस्मान द्वारा आरटीआई मांगने वाले लोगों पर सरकारी अधिकारियों द्वारा ब्लैकमैलिंग या रिश्वत मांगने के आरोपों की जांच कराये जाने पर कड़ा ऐतराज़ किया है.
उन्होंने श्री उस्मान को पत्र लिख कर कहा है कि ये आदेश आरटीआई एक्ट के खिलाफ हैं क्योंकि इस एक्ट में आयुक्त को सुनवाई की शक्तियां धारा 18 तथा धारा 19 में दी गयी हैं, जिसमे धारा 18 में सूचना नहीं मिलने अथवा गलत सूचना मिलने पर सूचना मांगने वाले द्वारा जन सूचना अधिकारी के खिलाफ शिकायत तथा धारा 19 में उसके द्वारा द्वितीय अपील की व्यवस्था है.
डॉ ठाकुर के अनुसार आरटीआई एक्ट में कहीं भी सूचना मांगने वाले की जांच करने अथवा जन सूचना अधिकारी की ऐसी शिकायतों को सुनने के अधिकार नहीं हैं, साथ ही उसके पास इस सम्बन्ध में पुलिस शिकायत सहित सभी विकल्प हमेशा उपलब्ध रहते हैं.
अतः उन्होंने श्री हाफिज से भविष्य में आरटीआई एक्ट के विपरीत कार्यवाही कर उसे प्रचारित नहीं करने का निवेदन किया है क्योंकि नियमविरुद्ध होने के साथ यह सूचना अधिकारियों को सूचना नहीं देने और बाद में ऐसे आरोप लगा कर बचने की प्रवृत्ति को बढ़ावा देगा.

Probe of RTI seekers against RTI Act, strongly protested
RTI activist Dr Nutan Thakur has strongly protested the enquiry orders issued by Information Commissioner Hafiz Usman regarding complaints of blackmail or bribe of Public Information Officers (PIOs) by RTI applicants.
In her letter to Sri Usman, she said that these orders are blatantly against the RTI Act because the Commission gets power of hearing in the Act only through sections 18 and 19 where section 18 is as regards the complaint made by applicants regarding or denial of information etc and section 19 is regarding second appeal by him.
Dr Thakur said that the RTI Act has no provisions for hearing the complaints of the PIOs or to enquire against the information seeker and the PIOs always have a right to make police complaint regarding any attempt of blackmail.
Hence she has requested Sri Usman not to act against the RTI Act and to publicize it because other than being illegal, these acts will also bolster the PIOs not to provide information and make such allegations later.
