केंद्रीय अन्वेषण ब्यूरो (सीबीआई) ने पूर्व सीबीआई प्रमुख आलोक वर्मा तथा उनके डिप्टी राकेश अस्थाना में हुए विवाद के समय सीबीआई में हुए ताबड़तोड़ तबादलों के संबंध में सूचना देने से इनकार कर दिया है. लखनऊ स्थित एक्टिविस्ट डॉ नूतन ठाकुर ने 24 अक्टूबर 2018 को श्री वर्मा तथा श्री अस्थाना को छुट्टी पर भेजने के बाद एम नागेश्वर राव को अंतरिम निदेशक बनाये जाने के बाद रात ही में किये गए तबादलों की सूचना मांगी थी.
इसी प्रकार उन्होंने श्री वर्मा के 09 जनवरी 2019 को वापस तैनात होने तथा 48 घंटे बाद हटने के बाद हुए ताबड़तोड़ तबादलों की सूचना मांगी थी. इन सूचना में इन स्थानांतरण आदेशों की प्रति, जिन तथ्यों के आधार पर ये तबादले किये गए तथा इनसे संबंधित पत्रावली के नोटशीट मांगे थे.
सीबीआई ने इस अनुरोध को मना करते हुए प्रार्थनापत्र नूतन को वापस कर दिया और कहा कि सीबीआई आरटीआई एक्ट, 2005 की धारा 24 में आरटीआई की परिधि के बाहर है.
नूतन ने इस मनाही के खिलाफ यह कहते हुए अपील किया है कि आरटीआई एक्ट की धारा 24 में भ्रष्टाचार संबंधित सूचनाएँ देने से मनाही नहीं है तथा जिस प्रकार से ताबड़तोड़ तबादले हुए तथा निरस्त किये गए, ये निश्चित रूप से उस समय सीबीआई में चल रहे भ्रष्ट आचरण से जुड़े हुए थे, जिनके संबंध में सूचना देय है.
CBI refuses info on Verma-Asthana era transfers
The Central Bureau of Investigation (CBI) has refused to provide information about various rapid and successive transfers that took place in CBI during the controversy between ex CBI Chief Alok Verma and his deputy Rakesh Asthana.
Lucknow based activist Dr Nutan Thakur had sought information about the various transfers made in 24 October 2018 night by M Nageshwar Rao appointed Interim Director after sending Sri Verma and Sri Asthana on leave. She also sought details about rapid transfers made Sri Verma was his reinstatement on 09 January 2019 and when he was again removed after 48 hours. These included information like copy of the official orders, the base material on the basis of which such drastic actions were taken and notesheet of the concerned files.
CBI rejected the RTI request by returning the application to Nutan saying that CBI has been exempted from the purview of RTI under the provisions of Section 24 of RTI Act, 2005.
Saying that section 24 of RTI Act does not exempt information related with corruption and claiming that the rapid way in which transfers were made and cancelled was primarily result of various corrupt practices in CBI at that point of time, Nutan has preferred an Appeal against these denial.
Text of Application
Sri Alok Verma, a 1979 batch AGMUT Cadre IPS officer and Sri Rakesh Asthana, a 1984 batch Gujarat cadre IPS officer were previously posted in Central Bureau of Investigation (CBI). On interim CBI director with immediate effect. On 24/10/2018 itself, many transfers at different ranks were made in CBI after assuming charge by Sri Rao. In view of the above facts, kindly provide the following information related with the above action/orders, in larger public interest- 1. Kindly provide a copy of the official orders made in this regards. 2. Kindly provide a copy of the base material/facts with CBI on the basis of which such drastic actions were taken. 3. Kindly provide details of the background as on CBI record on the basis of which such drastic actions were taken. 4. Kindly provide a copy of the entire file (including notesheet and correspondence) of CBI as regards the above action/transfer orders, made immediately after taking charge by Sri Rao, as new Director. Note- This is not exempt u/s 24 of RTI Act as it is related with matter of serious corruption and impropriety. It is being prayed that the above information are in larger public interest as the extremely hurried and unprecedented transfers made immediately after two officers were sent on forced leave and taking charge by new Director were clearly linked to internal corruption and extreme exigency in CBI. Hence information is not at all exempt u/s 24 RTI Act.

Remarks :- In this context, it is informed that CBI has been exempted from the purview of RTI Act 2005 and placed at Sl. No. 23 of the Second Schedule, subject to the provisions of Section 24 of RTI Act, 2005. Appeal against this reply, If any, would lie before the First Appellate Authority i.e. Dy. Director (Admn.), CBI, HO, New Delhi-03 within 30 days from the date of receipt of this reply.
