Amitabh Thakur : शायद आपराधिक लापरवाही करने वाले डॉक्टरों से कानूनी लड़ाई आसान नहीं है. यह बात अपनी पत्नी ममता शुक्ला की मौत के मामले में न्याय पाने को संघर्षरत अलीगंज निवासी सुरेश चन्द्र शुक्ला हर कदम पर महसूस कर रहे हैं. हेपेटाइटिस-सी से पीड़ित सुश्री ममता की मौत एसजीपीजीआई, लखनऊ में हो रहे इलाज के दौरान हो गयी. श्री शुक्ला ने इसके लिए गैस्ट्रोइंटेरोलोजी विभाग के डॉ विवेक आनंद सारस्वत और डॉ श्रीजीथ वेणुगोपाल को दोषी बताया कि उन्होंने प्रयोग के तौर पर जानबूझ कर ट्रायल ड्रग थाइमोसीन अल्फा-1 इंजेक्शन दिया जिससे हड्डी का कैंसर होने की काफी सम्भावना रहती है और जो मात्र हेपेटाइटिस बी रोगियों के लिए अनुमन्य है.
श्री शुक्ला ने इस सम्बन्ध में थाना पीजीआई में मार्च 2014 में मुक़दमा लिखाया, वह भी मेरे सीधे हस्तक्षेप के बाद. तब से वे न्याय के लिए लगातार दौड़ रहे हैं. पहले कोड ऑफ़ मेडिकल एथिक्स 2002 के पैरा 1.3.2 के तहत अपनी पत्नी के इलाज से जुड़े मेडिकल रिकॉर्ड मांगे जाने पर पीजीआई उनकी प्रार्थना की अनदेखी करता रहा जबकि 72 घंटे में यह सूचना दिया जाना विधिक दायित्व है. उन्हें ये रिकॉर्ड भी तभी मिले जब मैंने पीजीआई के निदेशक को सूचना दिए जाने तथा सूचना नहीं मिलने पर एथिक्स कोड के पैरा 8 में कार्यवाही किये जाने की बात कहते हुए पत्र लिखा.
अब श्री शुक्ला पुलिस द्वारा माँगा गया स्वतंत्र चिकित्सकीय अभिमत प्राप्त करने के लिए दौड़ लगा रहे हैं. सीएमओ, लखनऊ ने यह मामला अपर सीएमओ डॉ डी के चौधरी और डिप्टी सीएमओ डॉ आर वी सिंह को संदर्भित किया है. श्री शुक्ला के अनुसार जब इस सम्बन्ध में अपनी बात कहने के लिए 26 सितम्बर को वे डॉ चौधरी से मिले तो डॉ चौधरी ने उनसे ना सिर्फ अपमानजनक व्यवहार किया बल्कि मामले का पीछा करने के लिए उन्हें भला-बुरा भी कहा और कहा कि क्या वे उनके कहने पर पीजीआई के डॉक्टर को फांसी पर चढ़ा दें. डॉ चौधरी ने उन्हें अगले दिन बुलाया जब उनके सामने डॉ सारस्वत इन डॉक्टरों के पास आये और उनके आते ही इन डॉक्टरों ने श्री शुक्ला की बात सुने बिना ही चैंबर से बाहर कर दिया.
श्री शुक्ला ने पुनः मुझसे संपर्क कर पूरी बात बतायी है जिसपर मैंने प्रमुख सचिव चिकित्सा और स्वास्थ्य को पत्र लिख कर विशेषज्ञ डॉक्टरों का एक नया बोर्ड गठित करवा कर निष्पक्ष चिकित्सकीय अभिमत दिलवाने हेतु निवेदन किया है ताकि श्री शुक्ला की लड़ाई अपने वांछित गंतव्य तक पहुँच सके.

Fight for justice against doctors
It is possibly not easy to fight against a doctor’s alleged negligence. This is what Aliganj, Lucknow resident Suresh Chandra Shukla is finding at each stage of his fight for justice in wife Mamata Shukla’s death.
Ms Mamata, suffering from Hepatitis-C, died while being treated at SGPGI, Lucknow. He alleged Dr Vivek Anand Saraswat and Dr Srijeeth Venugopal of Gastroenterology department as being criminally liable for using the trial drug Thymocin Alpha-1 injection despite fully knowing that it has bone cancer as its side-effect and is permitted only for Hepatitis B patients.
Sri Shukla got his FIR registered in PGI police station, Lucknow in March 2014.after I personally intervened in that matter. Since then, he has been running from pillar to post but justice continues to elude him.
First he was refused the medical records of his wife’s treatment he had sought from SGPGI under Para 1.3.2 of the Code of Ethics Regulations, 2002 where providing such information within 72 hours is mandatory. He could get only after I wrote to SGPGI Director to immediately provide the information or I would approach the MCI for action under Para 8 of this Code.
He is again facing problems in getting an independent medical opinion sought in the investigation by the Police. CMO Lucknow has referred this case to Dr D K Chaudhary, Additional CMO and Dr R V Singh, Deputy CMO. Sri Shukla says that when he met Dr Chaudhary on 26 September, Dr Chaudhary not only behaved improperly with him, he also scolded Sri Shukla for pursuing the matter. Dr Chaudhary called Sri Shukla on the next date when he saw these doctors hobnobbing with Dr Saraswat. As per Sri Shukla, these doctors asked him to leave the room even without hearing him.
Sri Shukla presented med an application on which I have written to Principal Secretary Health and Family Welfare to get an expert medical committee formed to provide its independent opinion so that Sri Shukla finally gets justice in his case.
