राष्ट्रीय राष्ट्रवादी पार्टी के अध्यक्ष प्रताप चन्द्र ने भारत निर्वाचन आयोग द्वारा प्रधानमंत्री को चुनावों के दौरान विशेष सुविधा दिए जाने के आदेश को चुनौती देते हुए इलाहाबाद हाई कोर्ट की लखनऊ बेंच में याचिका दायर किया है.
याची की अधिवक्ता डॉ नूतन ठाकुर ने बताया कि निर्वाचन आयोग ने आदर्श आचार संहिता बनाया जो सभी राजनैतिक दलों एवं प्रत्याशियों द्वारा चुनाव के दौरान पालन किये जाने वाले दिशानिर्देश हैं.
इन दिशानिर्देशों में किसी सत्ताधारी दल के मंत्री को सरकारी यात्रा को किसी भी प्रकार से चुनावी यात्रा के साथ सम्बद्ध नहीं करने तथा चुनावी यात्रा में अनुचित ढंग से सरकारी संसाधनों का प्रयोग नहीं करने के निर्देश भी शामिल हैं.
इस संबंध में प्रधानमंत्री कार्यालय ने 07 अक्टूबर 2014 को आयोग से यह अनुरोध किया कि अगले दिन होने वाली प्रधानमंत्री की महाराष्ट्र यात्रा को आदर्श आचार संहिता से मुक्त कर दिया जाये. इस पर चुनाव आयोग ने बिना मांगे ही अपने मन से यह आदेश कर दिया कि प्रधानमंत्री को हमेशा के लिए आदर्श आचार संहिता के इस प्रावधान से मुक्त किया जाता है.
याचिका के अनुसार आयोग के इस आदेश ने बराबरी के सिद्धांत को पूरी तरह खंडित कर दिया है और केंद्र की सत्ताधारी पार्टी को भारी लाभ दे दिया है, जबकि आयोग ने स्वयं से सिद्धांत बनाये थे तथा इस हेतु आदर्श आचार संहिता का सृजन किया था.
अतः याचिका में आयोग के इस आदेश को ख़ारिज करते हुए बराबरी की स्थिति कायम करने की प्रार्थना की गयी है.
Petition against non-application of Model Code on PM in elections
Rashtriya Rashtravadi Party through its President Pratap Chandra hss filed a Petition in Lucknow bench of Allahabad High Court challenging the non-application of Model Code of Conduct to Prime Minister during elections.
The petitioners’ counsel Dr Nutan Thakur said that the Election Commission of India framed Model Code of Conduct which is a set of guidelines issued by the ECI for conduct of political parties and candidates during elections. This includes the rule that the Ministers shall not combine their official visit with elctioneering work and shall not also make use of official machinery or personnel during the electioneering work
The Prime Minister Office requested the Commission on 07 October 2014 that the PM shall be granted one time exemption from MCC for a particular election trip. Instead the Commission, completely on its own, issued Instruction that the Commission has decided to exempt the PM from the operation of these provision pertaining to the combining of official visit with electioneering visit for all future elections.
As per the petition, this has completely disturbed the level playing field allegedly being built by the Commission through so many efforts, including the Model Code, giving massive advantage to Party in Power in the Center.
Hence the petition prays to quash this order.
