तो कभी भी रिटायर नहीं होता अखबारकर्मी!

चौंक गए होंगे आप कि अखबार में काम करने वाला कर्मचारी रिटायर क्यों नहीं होता जबकि हर पेशे में काम करने वाले कर्मचारी की नौकरी में आने की कोई उम्र हो या न हो, रिटायर होने की आयु तो होती ही है। अब दिमाग में यह सवाल कौंधना स्वाभाविक है कि यही एक ऐसा पेशा क्यों है जहां सेवा से निवृत्त होने की कोई सीमा क्यों नहीं है जबकि समाचार पत्रों में काम करने वाले कर्मचारी श्रमजीवी पत्रकार अधिनियम 1955-56 से आच्छादित हैं और इनके साथ श्रमजीवी शब्द जुडा होने के कारण ये अपने-अपने प्रदेशों के श्रम विभाग से नियंत्रित होते हैं।

मैंने सूचना का अधिकार अधिनियम 2005 के तहत 7-1-16 को मांगी गई जानकारियों में एक समाचार पत्रों में कार्यरत कर्मचारियों की सेवानिवृत से संबंधित थी। अपने सवाल में मैंने सरकारी कर्मचारी का उदाहरण देते हुए पत्रकारों के सेवनिवृत की जानकारी चाही थी। उत्तराखण्ड के श्रम विभाग ने अपने पत्र (पत्रांक 1216/दे०दून-सू०अधि०अधि०/2016 दिनांक 2-3-16) के बिन्दु चार में बताया कि समाचार पत्र-प्रतिष्ठानों में कार्यरत कर्मचारियों पर सरकारी सेवा में कार्यरत कर्मचारियों की सेवानिवृत्त की आयु की सेवाशर्त लागू नहीं होती।

बताते चलें कि मैंने अब तक श्रम विभाग से जितने भी सवाल किये हैं सभी पत्रकारों/गैर पत्रकारों को श्रमजीवी पत्रकार अधिनियम के दायरे में किये हैं। मैंने यह जानकारी भी उसी दायरे के तहत मांगी थी किंतु श्रम विभाग ने जवाब सरकारी कर्मचारी का उदाहरण देते हुए दिया। वैसे उसके लिए यह कोई नई बात नहीं है। उनसे पूंछो कानपुर के बारे में तो वो बतायेंगे (पहले तो बतायेंगे नहीं कुछ सवाल का प्रश्नवाचक की आड में टाल जाएंगे तो कुछ सूचना को अपने कार्यालय में धारित न होने की बात कहकर टाल जाने की बात कहते हैं जबकि 30 दिन का समय सूचना मंगाने के लिए ही दिया जाता है यानि जो सूचनाएं अन्य विभाग की हो उसे तय समय पांच दिन के भीतर संबंधित विभाग को अंतरित कर समय पर सूचना दी जाए)।

बहरहाल, श्रम विभाग की सूचना पर ही कायम रहें तो क्या अखबारों में काम करने वाला कर्मचारी कभी रिटायर नहीं होता ? वह या पत्र-प्रतिष्ठान जब तक चाहें कर्मचारियों से काम लें। अगर ऐसा है तो श्रम कानून का उल्लंघन नहीं है। बताते चलें कि सहारा इंडिया ने अपने मीडियाकर्मियों की सेवानिवृत्त की आयु 60 से बढाकर 65 कर दी थी। यह आदेश सहारा मीडिया के हेड उपेन्द्र राय ने अपने पहले कार्यकाल में किया था किंतु दूसरे कार्यकाल के अंतिम दौर (जब सहारा संकट के दौर में था ) में 60 साल से अधिक आयु के 80 से ज्यादा कर्मचारियों को नौकरी से निकाल दिया। अब सवाल यह उठता है कि जब सहारा मीडिया में रिटायरमेंट की आयु 60 से 65 हो गयी है तब 80 से ज्यादा कर्मचारियों को क्यों निकाला गया। लगे हाथ एक सवाल सहारा के उच्च प्रबंधन से क्या उनका अपना नियम- कानून श्रम कानून से ऊपर है क्या?

कई पत्रकारों की नौकरी खा गया श्रम विभाग

‘नाम बडे दर्शन छोटे’ यह कहावत श्रम विभाग पर अक्षरश: लागू होती है। हालांकि इसका गठन श्रमिकों के हितों की रक्षा के लिए किया गया था। चूंकि ‘श्रमजीवी पत्रकार अधिनियम 1956’ के तहत अखबारों में कार्यरत कर्मचारी श्रम विभाग से गवर्न होते हैं इसलिए राष्ट्रीय सहारा देहरादून के कर्मचारियों ने श्रम विभाग का दरवाजा खटखटाया। तीन महिला कर्मचारियों सहित 42 पत्रकारों/गैरपत्रकारों ने 14 जुलाई 15 को एक हस्ताक्षरयुक्त ज्ञापन देहरादून स्थित अपर श्रम आयुक्त कार्यालय में दिया। एक माह बाद 14-08-15 को सहायक श्रम आयुक्त एनसी कुलाश्री ने यूनिट हेड को लिखे अपने पत्र (5461 – 62 दे.दून. – आई.आर. – राष्ट्रीय सहारा / 15 दिनांक 14-08-15 ) के माध्यम से 07-08-15 को हाजिर न होने की बात कहते हुए 18-08-15 को फिर तलब किया। बताते चलें कि इससे पूर्व सहायक श्रम आयुक्त ने 04-08-15 को पत्र (5047-48 दे० दून० – आई०आर० – राष्ट्रीय सहारा / 15 दिनांक 04-08-15) के माध्यम से 07-08-15 को तलब किया था।

बताते चलें कि अन्य यूनिटों की तरह यहाँ के कर्मचारियों को महीनों से बराबर वेतन नहीं मिल रहा था। अन्य यूनिटों की तरह यहां के कर्मचारियों ने भी हडताल में बढ-चढकर हिस्सा लिया था। यहां के साथियों जज्बे का आलम यह रहा कि उनके गुस्से का ” ताप ” प्रबंधन बरदाश्त न कर सका। सबसे पहले यहां के लोगों पर गाज गिरी। 29-01-16 को लगभग छह लोग हटा दिये गए वो भी बिना किसी जुर्म के। इन सभी कर्मचारियों पर कोई आरोप नहीं था। प्रबंधन ने न कोई नोटिस दिया न कोई जांच करायी। अपने द्वारा बनाये गए नियम 40-48 के तहत दूध में पडी मक्खी की तरह निकाल दिया। निकाले जाने के बाद इन कर्मचारियों ने डी.एल.सी को अपना खुदा मानते हुए एक बार फिर उनका दरवाजा खटखटाया। धीरे-धीरे छह होने को जा रहे हैं एक को भी न्याय नहीं मिला।

एक कहावत है ” गए थे रोजा बख्शवाने ‘ गले पडी नमाज ” यानी रोजे से आजिज मुसलमान भाई खुदा से इसे बख्शवाने गए तो इससे निजात खुदा दिला नहीं पाये बल्कि पांच टाइम की नमाज औऱ उनपर थोप दी। ठीक ऐसा ही राष्ट्रीय सहारा देहरादून के साथियों के साथ हुआ वे जुलाई 15 में वेतन न मिलने की शिकयत लेकर श्रम विभाग की शरण में गए थे वेतन दिलाने की कौन कहिए थोक में कर्मचारी निकाल दिये गए। संविदा कर्मियों का नवीनीकरण नहीं किया। यही नहीं काफी कर्मचारियों से जबरन इस्तीफा लिखवा लिया। मौजू है कि यह संस्थान (सहारा इंडिया) खुद को विश्व का सबसे बढा परिवार बताता है और यह कहते भी नहीं अघाता कि हमारे यहां न कोई मालिक है और न कोई नौकर, सब के सब कर्तव्ययोगी हैं।

बहरहाल बात मुद्दे कि राष्ट्रीय सहारा देहरादून के साथियों ने नियमित वेतन न देने सहित तीन साल से डीए शून्य होने, बोनस न देने की शिकायत की थी। खुद को विश्व का विशालतम परिवार की हकीकत यह है कि यह 10-10/15-15 साल कर्मचारियों को प्रमोट नही करता। श्रम कानून के तहत न काम लेता है और न वेतन देता है। श्रम कानून के तहत काम के घंटे साढे पांच है शिफ्ट इनकी आठ घंटे की है वो भी कागज पर। गौरतलब है कि इस बात की भी शिकायत श्रम विभाग से की गई थी। श्रम विभाग न तो इस दिशा में कोई कार्रवाई करता है और न सूचना का अधिकार अधिनियम 2005 के तहत मांगे जाने वाली सूचना की जानकारी देता है। इसे ही कहते हैं जबरा मारय रोअय न देय।

    iपत्रकारों की रि‍टायरमैंट उम्र के बारे में 2 जुलाई्र 1967 के असाधारण गजट सेंट्रल बेज र्बोर्ड फार वर्कि‍ग जर्नलि‍स्‍ट के एम मैथ्‍यू और के ए नेतकल्‍लपा के द्वारा की संस्‍तुति‍यों में चर्चा जरूर हुई है कि‍न्‍तु वे पत्रकारों की सेवानि‍वृत्‍ति‍ आयु 58 साल की उम्र का उल्‍लेख करने के साथ ही यह भी संस्‍ततुति‍ कर गये थे कि‍ अगर डि‍स्‍ट्रि‍क्‍ट मैडीकल अफसर उसे सेवा करतते रहने के लि‍ये फि‍ट बताये तो वह दा साल और नौकरी कर सकता है। उन्‍होंने इसका उल्‍लेख करने के साथ ही यह भीं संस्‍तुति‍ की थी कि‍ पत्रकारों की सेवाशर्तां संबधि‍त 55 के अधि‍नि‍यम में संशोधन के रूप में समाहि‍त कि‍या जाना चाहि‍ये।
    इसी क्रम में पी आई बी भारत सरकार के द्वारा जारी प्रेस वि‍ज्ञाप्‍ति‍ भी संलग्‍न कर रहा हू जि‍समे कि‍ पत्रकार की रि‍टायरमेंट की उम्र का वाकायादा 65साल कि‍या जाना उल्‍लेखि‍त है।

    Report of National Wage Boards for Working Journalists and other Newspaper Employees presented to the Government
    The Chairman National Wage Boards for Working Journalists and other Newspaper Employees, Justice G. R. Majithia and the members of the Wage Boards presented their final Report to Shri P. C. Chaturvedi Secretary Ministry of Labour & Employment in New Delhi today. Speaking to the media persons after the presentation function Justice Majithia said that a fine, fair and judicious balance has been achieved between the expectations and aspirations of the employees and the capacity and willingness of the employers to pay. He further said that the report has made some suggestions for the consideration of the government on issues like post-retirement benefits, a forward looking promotion policy, measures to improve enforcement of the Award, need for improving data base of the RNI, etc.

    The Report has classified newspaper establishments into eight categories, and news agencies into four categories based on gross revenues. Recommended pay scales have been classified into six categories for jobs in each class of establishment. Pay scales have been worked out by adding old basic pay and DA admissible up to June 2010 plus 30 Percent of interim relief. The revised pay would have a component of ‘variable’ pay at the rate of 35 percent for employees working in first top four classes of establishments and 20 percent for other four classes of establishments. The ‘variable’ pay will be added in the revised basic pay for calculation of all allowances. Effective date of implementation would be from 1st of July 2010.

    The monthly emoluments for the lowest category of employee in the lowest class of establishment would work out to be Rs. 9000 for the basic pay at floor level minimum wage of Rs. 5000. The revised basic pay would however range from Rs. 9000 to Rs. 17500 for non-journalists and from Rs. 13000 to Rs. 25000 for working journalists in the top establishment having gross revenues of more than Rs. 1000 crores.

    As far as social security measures are concerned possibility of granting paternity leave to male employees, retirement age of 65 years, and exploring pension scheme possibilities have been suggested going beyond the mandated wage structure revision.

    The wage board has further recommended night shift allowance, hard ship allowance; transport allowance and House rent allowance for different class of establishments. It has recommended that a permanent mechanism in the form of a tribunal be set up to adjudicate on complaints regarding non-implementation or circumvention of the Award. Also Employers are to ensure that while engaging contractual workers they must atleast offer same salary for the same work which is performed by the regular employee.
    The Ministry of Labour & Employment vide Notifications No. S.O. 809(E) and 810 (E) dated 24th May 2007 as well as Notifications No. S.O. 1066 (E) and 1067(E) dated 3.7.2007 had constituted two separate statutory Wage Boards – one for Working Journalists and another for other Newspaper Employees – in exercise of the powers conferred by Section 9 of the Working Journalists and other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 (45 of 1955) under the Chairmanship of Dr. Justice K. Narayana Kurup, formerly Judge, High Court of Kerala and Acting Chief Justice, High Court of Madras for the purpose of fixing and revising rates of wages in respect of Working Journalists and Other Newspaper Employees, respectively. Consequent upon resignation of Dr. Justice K. Narayana Kurup, the Government of India then appointed Justice G.R. Majithia as Chairman of Wage boards vide Notification nos. S.O. 580(E) and S.O. 581 (E) dated 28th February 2009. The Wage Boards are tripartite in character in which representative of workers, employers, independent members participate and finalize the recommendation. The Wage Boards for journalists and non – journalist newspaper and news-agency employees are statutory in nature. The prime responsibility for implementing the recommendations of the Wage Board rests with the concerned State Governments / Union Territories under the provision of the act.

    The Composition of the above mentioned two Wage Boards are given below :
