बहुजन समाज पार्टी द्वारा नोटबंदी के बाद दिल्ली के करोल बाग़ स्थित यूनियन बैंक ऑफ़ इंडिया के अपने पार्टी अकाउंट में 02 दिसंबर से 09 दिसंबर 2016 के बीच 104 करोड़ रुपये के पुराने नोट जमा कराये जाने के सम्बन्ध में निर्वाचन आयोग ने पार्टी को भारी राहत दी है. इस सम्बन्ध में इलाहाबाद हाई कोर्ट की लखनऊ बेंच में पीआईएल दायर करने वाले प्रताप चंद्रा की अधिवक्ता डॉ नूतन ठाकुर ने बताया कि निर्वाचन आयोग ने 29 अगस्त तथा 19 नवम्बर 2014 द्वारा वित्तीय पारदर्शिता सम्बन्धी कई निर्देश पारित किये थे.
इन निर्देशों में कहा गया है कि कोई भी राजनैतिक दल उन्हें चंदे में प्राप्त नकद धनराशि को प्राप्ति के 10 कार्यकारी दिवस के अन्दर पार्टी के बैंक अकाउंट में अवश्य ही जमा करा देगा और इन निर्देशों का उल्लंघन किये जाने पर पार्टी के खिलाफ निर्वाचन चिन्ह (आरक्षण एवं बटाई) आर्डर 1968 के प्रस्तर 16ए में मान्यता रद्द करने सहित तमाम कार्यवाही की जा सकती है.
प्रताप चंद्रा ने कोर्ट को कहा था कि नोटबंदी का आदेश 08 नवम्बर को आया था पर बसपा ने 2 दिसंबर के बाद 104 करोड़ रुपये जमा कराये, जो सीधे-सीधे इन निर्देशों का उल्लंघन है, जिसपर कोर्ट ने आयोग को तीन माह में कार्यवाही के आदेश दिए थे.
नूतन ने बताया कि आयोग के नोटिस दिनांक 02 मार्च 2017 पर बसपा ने अपने दिनांक 12 मार्च के उत्तर में स्वीकार किया कि उन्होंने नोटबंदी के बाद 104.36 करोड़ कैश जमा कराया पर साथ ही कहा कि पार्टी का एकमात्र अकाउंट दिल्ली में है, अतः पूरे देश से पैसा पहले दिल्ली लाया जाता है और फिर जमा होता है. यह सारा पैसा नेताओं की विभिन्न रैलियों में इकठ्ठा हुआ था. पार्टी ने नोटबंदी के तुरंत बाद बैंक से संपर्क किया लेकिन बैंक ने तत्काल पैसा जमा कराने के असमर्थता दिखाई और बैंक की सुविधानुसार धीरे-धीरे पैसा जमा किया गया.
इस पर आयोग ने अपने आदेश दिनांक 04 मई 2017 द्वारा मामले की असाधारण स्थिति और बसपा द्वारा बताई गई व्यवहारिक परेशानी को संज्ञान लेते हुए प्रकरण को समाप्त करने का निर्णय लिया. साथ ही बसपा को भविष्य में इन निर्देशों का कड़ाई से पालन करने के भी निर्देश दिए.
Election Commission major relief to BSP
The Election commission of India has given major relief to Bahujan Samaj Party as regards the Rs. 104 crores cash money deposited by it in old between 02 December 20 to 09 December 2016 in the Party’s bank account in Karol Bagh branch, New Delhi after the demonetization order.
Dr Nutan Thakur, counsel of Petitioner Pratap Chandra who had Public Interest Litigation in the Lucknow bench of Allahabad High Court told that the Election Commission had issued Guidelines for financial transparency on 29 August and 19 November 2014. These Guidelines say that any political party must deposit its cash collections in its bank account within 10 working days of the fund collection and any violation of these Guidelines would lead to action including cancelling the recognition of the political party under the provisions of Para 16A of the Election Symbols (reservation and Allotment) Orders 1968.
Pratap Chandra had told in the Court that BSP had deposited Rs. 104 crores cash money in old currency after 08 November, which is a clear violation of these Guideline, to which the Court had directed the Commission to take action in 03 months.
Nutan said that Election Commission issued notice to BSP on 02 March 2017 to which
it responded on 12 March, where it accepted depositing Rs. 104.36 crores during the said period. The Party said that it has only one Bank account in Delhi and all the cash is first transferred to Delhi where it is deposited. It said that the money was collected at various rallies held by Party leaders. The Party immediately contacted the Bank to get the cash deposited but the Bank officials showed inability to deposit such huge amount in one go. Hence the money was deposited based on the Bank’s ability to count and deposit it.
Through its order dated 04 May, the Commission has accepted the BSP’s explanation and dropped the matter, citing the peculiar circumstances and practical difficulties explained by BSP as the reason. It has also warned the Party to scrupulously follow the Instructions in future.
