Majithia : Registry has assured that the Case will be listed on the priority basis

The office of the ‘Indian Federation of Working Journalists’ (IFWJ) has been inundated with innumerable telephone calls and emails to know as to why the date of hearing of the Majithia case, which was fixed on 17th January 2017, was not taken up? On the last of date of hearing i.e. 10th January the matter was listed for arguments on Legal Issues. The arguments remained inconclusive.

On the last of date of hearing i.e. 10th January the matter was listed for arguments on Legal Issues. The arguments remained inconclusive.

Thereupon the bench consisting of Justice Ranjan Gogoi and Justice Ashok Bhushan posted it for 17th of January 2017. We approached the listing branch of Registry to know the reason for deletion. We have been informed that some changes have been introduced for the listing of the cases by the Hon’ble Supreme Court in consultation with the Supreme Court Bar Association. Although it is very rare to delete any case if the date is fixed by the Bench itself, yet in certain circumstances it is done, as in this case it has happened.

As per the new policy of listing from Tuesday to Thursday very limited number of case would be taken up. For the time being only a few time consuming cases will be heard on these three days. Be that as it may, the Registry has assured that the Majithia Case will be listed on the priority basis because of its urgency.

Change of eminent lawyer by Ushodaya is perplexing

We would also like to inform that on the last date of hearing i.e. 16th of November 2016 Shri Gopal Subramanian was fielded by the Ushodaya Publications, the publishers of the Eenadu newspaper, and he had persuaded the Court with his uncommon skill to adjourn the case because he wanted some clarifications from his client. He had told the court in a most unequivocal and categorical manner that ‘implementation of Majithia means complete implementation and not the façade of implementation’. He had also assured the Court that he would prevail upon his client the Ushodaya Publications and particularly to its owner Mr. Ramoji Rao to comply with the orders of the Supreme Court by implementing the Majithia Recommendations in its letter and spirit. It was very reassuring for the employees but it appears that he (GS) has not been able to convince Mr. Ramoji Rao and, therefore, he decided to quit. Now he has been replaced by another Senior Advocate Shri Shyam Divan by the Ushodaya Publications.

This attitude of Ramoji Rao has completely exposed his duplicity, hypocrisy and his having two faces. The conduct of the other newspaper owners like Dainik Jagran, Dainik Bhaskar and Rajasthan Patrika is more appalling than Ramoji Rao and highly reprehensible to say the least. Therefore, we have to remain united to defeat the evil incarnates.

मजीठिया : रजिस्ट्री का आश्वासन जल्द सूचीबद्ध होगा मामला

यह जानने के लिए कि मजीठिया मामले की सुनवाई, जो 17 जनवरी को तय की गई थी, के तय तिथि पर ना हो पाने को लेकर इंडियन फैडरेशन आफ वर्किंग जर्नलिस्ट (आईएफडब्ल्यूजे) के कार्यालय में असंख्य टेलीफोन कॉल और ईमेल की बाढ़ सी आ गई गई है। सुनवाई की पिछली तारीख यानि 10 जनवरी को यह मामला कानूनी मुद्दों पर बहस के लिए 17 जनवरी को सूचीबद्ध किया गया था। इस दौरान बहस निष्कर्षहीन  रही थी। इसके बाद न्यायमूर्ति रंजन गोगोई और न्यायमूर्ति अशोक भूषण की बेंच ने सुनवाई को 17 जनवरी तक बढ़ा दिया था।

हमने रजिस्ट्री की लिस्टिंग शाखा से मामले को तारीख से हटाने के कारण का पता लगाने के लिए संपर्क किया, तो  हमें बताया गया कि मामलों को सूचीबद्ध करने को लेकर सुप्रीम कोर्ट बार एसोसिएशन के साथ विचार-विमर्श करके माननीय उच्चतम न्यायालय द्वारा कुछ बदलाव किए गए हैं। यद्यपि अगर तारीख खंडपीठ द्वारा ही तय की गई हो तो इसे सूची से हटाया जाने का मामला बहुत ही दुर्लभ होता है, हालांकि कुछ निश्चित परिस्थितियों में ऐसा होता है, जो इस मामले में हुआ है।

गुरुवार से मंगलवार तक सूचीबद्ध किए जाने वाले मामलों को लेकर बनाई गई नीति के अनुसार बहुत ही सीमित संख्या में मामले सुने जाएंगे। आने वाले समय में इस दौरान केवल कुछ समय लेने वाले मामलों को ही इन तीन दिनों में सुना जाएगा। जो भी हो, रजिस्ट्री ने आश्वासन दिया है कि मजीठिया मामले को इसकी अति अवश्यकता की वजह से प्राथमिकता के आधार पर सूचीबद्ध किया जाएगा।
