रामपुर में मुलायम सिंह के जन्मदिन समारोह के लिए स्कूलों की बंदी और बच्चों को मुलायम सिंह के नारे लगाने के लिए घंटों खड़ा रखने को बाल अधिकारों का खुला उल्लंघन बताते हुए सामाजिक कार्यकर्त्ता डॉ नूतन ठाकुर ने इस सम्बन्ध में राष्ट्रीय बाल अधिकार संरक्षण आयोग को शिकायत भेजी है. शिकायत संख्या 201400001016 पर दर्ज इस ऑनलाइन शिकायत में कहा गया है कि एक नेता, जिन्हें ये बच्चे संभवतः जानते तक नही थे, के लिए नारे लगाने को इन बच्चों को घंटों खड़ा रखना आईपीसी की धारा 342 में अपराध है.
इस प्रकार 21 और 22 नवम्बर को डीएम रामपुर सी पी त्रिपाठी के आदेशों पर इस जश्न के लिए कई स्कूलों को बंद करने का आदेश देना शिक्षा का अधिकार अधिनियम के खिलाफ है. अतः डॉ ठाकुर ने आयोग से इन दोनों बिन्दुओं पर जांच कर डीएम रामपुर सहित जिला प्रशासन की जिम्मेदारी नियत करने का आग्रह किया है ताकि यह भविष्य में बाल अधिकारों का हनन करने वालों के लिए एक उदाहरण बन सके.

Subject- Enquiry into the closure of schools and use and extreme harassment of children for a political program in Rampur
The petitioner Dr Nutan Thakur, a luck now based social activist working in the field of transparency and accountability in governance and Human Rights issues presents an extremely sad and disgusting incidence that happened in Rampur (UP) yesterday (21/11/2014) during the 75th birthday celebrations of Samajwadi Party President Sri Mulayam Singh Yadav.
While the pomp and show and the alleged misuse of government machinery for private and political event is a separate matter and not exactly the concern of the Child Rights Commission, but there are two specific aspects which the petitioner like to bring in the notice of this Commission.
The first is that children were used, in all certainty against this wish, along the 12 kilometre from Ambedkar Park to Mohd Ali Jauhar University campus, to line up and cheer for a leader whom they possibly did not even know. As per the news items from various respected media sources, children from 20 schools were transported to line the route where the children had to remain stranded for hours to cheer a political leader, in all certainty in a forced manner because it can be almost naturally presumed that no school-going child will himself line up for hours for cheering a political leader.
The second aspect is that many schools in Rampur were closed on 21/11/2014 and 22/11/2014 on the orders of Sri CP Tripathi, District Magistrate, Rampur, who is presumed to have said- “All departments have been working to ensure that Netaji’s 75th birthday is celebrated in a grand manner.” These schools were asked to declare a holiday for two days as school buildings are used to provide accommodation to the security forces.
There is no need saying that both the above aspects are serious actions against the interest of children and clearly comes under the category of infringement of child rights. The Commission, which emphasizes the principle of universality and inviolability of child rights, needs to immediately take up this issue and enquire into the manner in which the district administration under DM Rampur harped upon the child rights of these children by making them forcibly stand for hours and by closing their schools for political celebrations.
This Commission has been mandated under Section 31 of the Right of Children to Free and Compulsory Education Act, 2009 to inquire into complaints relating to violation of child’s right to free and compulsory education and to take necessary steps as provided under Section 15 of the Commission for Protection of Child Rights, 2005.
In addition, the forcible attendance of the children and their restrain for this purpose seems to come under the category of offence under section 342 IPC, if through enquiry it is proved that the children were made to stand as cheer-leaders against their will.
Thus, from the above facts, it seems imperative to enquire into the above facts/complaints so as to arrive at the truth as regards the child rights deprived in the above incidents and the role of District administration, including that of DM, Rampur Sri C P Tripathi in this.
This issue seems extremely important because of the gross insensitivity shown here to child rights and because any appropriate action in this administration sponsored mega- event will set an example for all others to refrain from doing similar acts of child rights violation in future.
