Hearing on Legal Issues on Majithia Starts in Supreme Court

Hearing on the legal issues of the Majithia Contempt case started today in the Supreme Court. It remained incomplete and will continue on the next Tuesday, 17th January. From the side of the employees Shri Colin Gonsalves, Senior Advocate, submitted that Section 20j of the Wage Board Award was being wrongly used by the newspaper owners to deny the benefits of the Award to employees. It was, in fact, incorporated to help those employees, who were being paid more than what the Wage Board had recommended.

Justice Bhachawat, a well-wisher of newspaper employees, passes away

In the death of Justice (Rtd.) U.N. Bhachawat yesterday morning, the newspaper employees have lost their true well-wisher. It was he who laid the foundation stone of the wage structures, allowances of the newspaper employees and the classification of the newspapers. Before Justice Bhachawat all other wage boards- Divatia, Shinde and Palekar- had run into rough weathers because of the objections and legal impediments created by the proprietors, led by notorious blackmailer Ram Nath Goenka. Recommendations of the first wage board were struck down by the constitution bench in the Indian Express case. Thereafter the Shinde wage committee was formed through an ordinance but, that too, could not do justice to employees. The Palekar wage board was constituted in 1975 but it could not function due to non-cooperation of the employers. Later on, it was converted into one man Tribunal. Therefore, the wage board under the chairmanship of Justice Bhachawat was the first of its kind, which prepared the ground for all other subsequent wage boards.

देश भर से इस बात को लेकर पूछताछ की जा रही है कि 16 नवंबर को सुप्रीम कोर्ट में मजीठिया मामले में हुई सुनवाई के दौरान क्या हुआ। हालांकि सुनवाई के दौरान कोर्ट रूम में कई अखबार कर्मी मौजूद थे। उन्होंने बाकी साथियों को इस संबंध में सूचनाओं का आदान-प्रदान भी किया है, फिर भी जिज्ञासा बनी हुई है। हालांकि इस दिन अखबार कर्मियों के पक्ष में कोई भी सुनवाई नहीं हुई। इस दौरान विशेषतौर पर इनाडू अखबार के प्रकाशक उषोदया पब्लिकेशन्स की ओर से उस समय आशा की किरण दिखाई दी, जब सीनियर एडवोकेट गोपाल सुब्रामण्यम ने यह कहते हुए कोर्ट से समय की मांग की कि वह मजीठिया वेजबोर्ड कार्यान्वयन से जुड़े विवरण पर अपने मुवक्किल एवं अखबार के मालिक रामोजी राव से चर्चा करना चाहते हैं।

Gopal Subramaniam Assures Implementation of Majithia

We have been getting inquiries from all over the country as to what had happened on 16th November in the Supreme Court during the hearing of the Majithia case. Many employees from the newspapers were present in the court room and they have communicated the information to other employees, yet the curiosity still persists. Although no hearing has taken place on that date yet for the employees, particularly of the Ushodaya Publications, the publishers of the multi edition Eenadu newspaper, there appeared to be the silver linings of hopes when, Senior Advocate Mr. Gopal Subramaniam sought time to from the Court to discuss the details of the implementation of the Majithia Wage Board from his client Mr. Ramoji Rao, the owner of the newspaper.

Uttarakhand Labour Commissioner Tenders Unqualified Apology to Supreme Court

The Labour Commissioner of Uttarakhand Dr. Anand Srivastava has profusely apologized to the Hon’ble Supreme Court of India for not appearing on the last date of hearing of the Majithia case on 23rd August 2016. In a sworn affidavit filed in the Supreme Court he has said that it has happened because of the inadvertent misunderstanding as he was under the impression that the Labour Commissioner has to be represented through the counsel.

Majithia Award: All is Hunky-dory in Uttarakhand; Says Government

The Uttarakhand Government has filed Majithia status report in the Supreme Court of India through its Principal Secretary, Ms. Manisha Panwar. The report says that no employee or employees’ union of any newspaper has filed any complaint against any newspaper in the state. The report further says that the publishers of the Dainik Hindustan newspaper, M/s Hindustan Media Venture Ltd. have implemented the Award in its both units of Dehradun and Haldwani. However, it does not mention about the class of newspaper.

Action Taken Report of Rajasthan speaks more about its inaction

Govt. of Rajasthan has yesterday filed ‘Action Taken Report’ on the implementation of the Majithia Wage Board Award in the Supreme Court. The State Government had earlier filed a status report, which contained the appointment of the Labour Inspectors and the submissions of employers and employees. In this report the State Government has informed that notices were issued to 893 newspaper establishments out of it 298 were daily newspapers, 220 weekly newspapers, 358 fortnightly newspapers and 17 monthly newspapers. As a matter of fact, this humongous exercise of the Public Relations Department has created more confusion than clarity with regard to the implementation by the newspaper owners and steps taken by the State Government to accelerate the implementation process.

All Puducherry newspapers have implemented Majithia Award

According to the status report filed in the Supreme Court of India by Shri Manoj Parida, the Chief Secretary to the Government of Puducherry all newspapers of the Union Territory have implemented the Majithia Award. There are eight newspaper establishments functioning in the Union Territory of Puducherry out of them, six have engaged 170 employees of various categories and they have implemented the recommendations of the Majithia Award. In the remaining two establishments the services of the employees of Villupuram Branch of Tamilnadu are utilised and hence do not fall within the jurisdiction of Puducherry.

Dainik Jagran and Dainik Bhaskar are the worst violators of Majithia Award : Govt. of Delhi

Government of NCT of Delhi has filed an Additional Affidavit in the Supreme Court of India containing 532 pages on the Status of the implementation of the Majithia recommendations by newspapers of Delhi. Interestingly, additional affidavit is nearly 20 times bulkier than the previous original Status Report which was full of factual howlers. This additional affidavit has been filed by K.R. Meena, Secretary-Cum-Commissioner (Labour), Government of Delhi.

Haryana Govt says four newspapers of the state have implemented Majithia

The status report on the implementation of the Majithia Wage Boards Award submitted by Government of Haryana says that there are 65 newspaper organisations in the state but only four of them namely; Amar Ujala, Sach Kahoon (Hindi, Punjabi), The Tribune and Dainik Tribune have implemented the recommendations of the Majithia Wage Award.

NO NEWSPAPER IS PUBLISHED FROM ANDAMAN AND NICOBAR!

There is no daily newspaper in the Union Territory of Andaman and Nicobar. There are a few small weekly newspapers which do not employ any regular employee. One or two persons are employed by them on hourly basis to bring out the weeklies. It has been stated by Mr. Madhu Sudhan Baidya, Labour Commissioner and Director of Employment Training (Andaman and Nicobar Administration) in his affidavit filed before Hon’ble Supreme Court of India.

Hon’ble Pradhan Mantri ji,

We write to you with pain and anguish over the exploitation and victimization of newspaper employees by their proprietors that has crossed all limits. The saddest part of it is that the Governments- Central as well as the States- have become the mute spectators to this sordid state-of-affairs.

Pandey Parmanand : Today (03.10.2015) was the second day of the strike of Dainik Jagran employees of NOIDA and they came out in large number at Jantar Mantar to sit on dharna. I marvel at the enthusiasm of the employees who in spite of all threat and intimidation of the Management defied the dictate and struck the work.

Majithia Award: it is as dismal in Madhya Pradesh as in other states

The story of Madhya Pradesh is no different from other states as far as the implementation of the Majithia Wage Award. Till date only six states viz. Delhi, Punjab, Madhya Pradesh, Jharkhand, Rajasthan and Sikkim have filed their status reports. The situation is in Madhya Pradesh is dismal and the condition of the newspaper employees is as pathetic, if not more, as in other states.

None of major newspapers of Punjab has implemented the Majithia says the affidavit of the State Labour Commissioner

The reports of Special Labour Inspectors appointed by the State Governments on the direction of the Hon’ble Supreme Court of India vide its order of 28.04.2015 to find out the status of the implementation of the Majithia Award in newspapers has now started trickling in. Sikkim has been the first Government, which sent its report through its Chief Secretary almost a month ago.

Apprise with factual position to Inspectors for Majithia

The struggle, rather the battle, for Majithia Awards has come to decisive phase of the history. Most of the governments have already appointed Special Labour Inspectors on the direction of the hon’ble Supreme Court of India on 28.04.2015. There are, however, some states, which find luxury in laziness, and they have yet to act on it. The major states, which have not moved in this direction so far are – Uttar Pradesh, Bihar, Odisha and West Bengal. This act of these laggard states itself amounts to the contempt of the Court.
